Terms of Service

1. Services

Ellatech Solutions provides web hosting, domain registration, VPS servers, website design, school management software, POS software, and AI tools through the FavourHost platform (favourhost.com). Service availability, features, and pricing are described on the website and are subject to change with reasonable notice.

2. Account responsibilities

• You must provide accurate registration information and keep it up to date.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to create an account and purchase services.
• Sharing account access credentials with third parties is not permitted.
• You are responsible for all activity that occurs under your account.

3. Payments and billing

• All prices are in Kenyan Shillings (KES) unless otherwise stated, and include 16% VAT.
• Payments are processed by Paystack (card) or Safaricom M-Pesa. We do not store card details.
• Monthly/annual services renew automatically unless cancelled before the renewal date.
• Failure to pay will result in service suspension after 7 days, and termination after 30 days.
• We reserve the right to change pricing with 30 days notice to existing customers.

4. Refund policy

• Web hosting: 7-day money-back guarantee for new subscriptions.
• Domain registrations: non-refundable once registered (domain registries do not refund).
• VPS and software products: evaluated on a case-by-case basis; contact support within 7 days.
• Website design services: deposit payments are non-refundable once work has commenced.

5. Acceptable use

You must not use our services to:

• Host, distribute, or facilitate illegal content under Kenyan or international law.
• Send unsolicited bulk email (spam) or conduct phishing campaigns.
• Distribute malware, ransomware, or any malicious software.
• Conduct DDoS attacks or attempt to disrupt other users' services.
• Infringe intellectual property rights of third parties.
• Violate the privacy or data protection rights of others.
• Engage in cryptocurrency mining without explicit written consent.

Violation of acceptable use may result in immediate service suspension without refund.

6. Uptime and service levels

We target 99.9% monthly uptime for hosting and VPS services. Scheduled maintenance windows will be announced with at least 24 hours notice. Downtime credits (if applicable) are the only remedy for SLA breaches — we are not liable for indirect losses resulting from downtime.

7. Data and backups

While we perform daily automated backups for shared hosting accounts, you are ultimately responsible for maintaining your own backups. We are not liable for data loss. VPS customers are responsible for their own backup strategy unless a managed backup service is purchased.

8. Limitation of liability

To the fullest extent permitted by Kenyan law, Ellatech Solutions' total liability for any claim arising from these terms or our services is limited to the amount you paid for the affected service in the preceding 12 months. We are not liable for indirect, incidental, special, or consequential damages.

9. Termination

Either party may terminate services with 30 days written notice. We reserve the right to suspend or terminate accounts immediately for violations of these terms or applicable law. Upon termination, you remain liable for all outstanding fees. We will provide a 14-day data export window upon termination unless the termination is for cause.

10. Governing law

These terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya, or through mutually agreed mediation as a first step.
